By the present Petition, the Petitioner has sought for the following substantive relief in terms of prayer clause (b) and (c) of the Petition which is as follows:

b) That this Hon'ble Court be pleased to quash and set aside the First Information Report bearing C.R. No. 325 of 2011 dated 13th August 2011, registered for the alleged offences punishable under Sections 452, 363, 511, 323, 506(2) and 143 of the Indian Penal Code with Swargate

Police Station, District: Pune, insofar as the present Petitioner is concerned.

c) That this Hon'ble Court be pleased to quash and set aside the Final Report / Charge-sheet bearing No. 154 of 2012, culminating in Regular Criminal Case No. 405025 of 2012, pending before the Hon'ble Judicial Magistrate First Class, Shivajinagar at Pune, insofar as the present Petitioner is concerned.

Ms. Dabholkar, learned APP appearing for the Respondent - State, submits that though the Petitioner herein was initially named in C.R. No. 325 of 2011 dated 13th August 2011, registered with Swargate Police Station, District: Pune, however, upon investigation chargesheet bearing No. 154 of 2012 was filed, which culminated in Regular Criminal Case No. 405025 of 2012 pending before the Judicial Magistrate, First class, Shivajinagar at Pune. 3.

Ms. Dabholkar, learned APP on instruction from the Investigation Officer states that Petitioner is not named in the Chargesheet bearing No. 154 of 2012. She therefore submits that the apprehension expressed by the Petitioner in this Petition does not

survive and there is no of action for the Petitioner to maintain this present Petition.

In view of the statements made by Ms. Dabholkar, learned APP appearing for the Respondent - State, Mr. Siddique, learned Advocate appearing for the Petitioner on instructions from the Petitioner craves leave to withdraw the present Petition. Leave to withdraw this Petition is granted.
