By the present Petition, Petitioners are seeking following substantive relief :
"(a) This Hon'ble Court may, by way of appropriate Order or direction, Quash and set aside FIR No 61/2022 Registered at Wanawdi Police Station along with Chargesheet against the Petitioners and along with Order taking Cognizance by Learned Judicial Magistrate First class on the same Charge sheet."

After the matter was heard for some time, Mr. Vipul Patil, learned Advocate for the Petitioners sought pass over. At this request, the matter was taken up. Mr. Vipul Patil on instructions from the Petitioners craves leave to withdraw this Petition with liberty to file application seeking discharge before the Trial Court at the appropriate stage. He submits that the next date fixed before the Trial Court is 5th March, 2026 for the purpose of framing of charge. He submits that an application seeking discharge would be filed before the Trial Court on the said date (5th March, 2026). He prays for a direction to the Trial Court for disposal of the said application within a stipulated time.

Mr. Kiran Shinde, learned APP does not object to the request made by Mr. Vipul Patil, Advocate appearing for the Petitioners.

In view of the above, leave granted to withdraw the present Petition with liberty as prayed. In the event, the Petitioners files an application seeking discharge before the Trial Court on 5th March, 2026 then the same be considered on its own
merits and in accordance with law. The Court of the 2nd Joint Judicial Magistrate, Cantonment Board, Pune is requested to make an endeavor to dispose of the said application for discharge expeditiously and at any rate within a period of 6 months from the date of its filling.

Writ Petition No. 283 of 2026 is disposed of as withdrawn.
