In this writ petition, the petitioner who is the de-facto complainant in C.R. No.440 of 2025 registered at the Nalasopara Police Station is seeking a direction to the respondent no.3 to incorporate certain offences in the Report. We are not inclined to entertain such a prayer in exercising jurisdiction under Article 226 of the Constitution of India. During investigation, no interference by the Court is permissible and it is absolute discretion of the Investigating Officer to carry out investigation (State of Bihar & Anr. v. J.A.C. Saldanha & Ors.1). We also think that the writ Court cannot exercise its powers to issue a direction to the respondent-police officer to add a few more offences or accused persons in the Report. The petitioner has adequate remedy in law which can redress his grievances after a chargesheet is filed. 2.

Writ Petition no.326 of 2026 is dismissed.
