By order dated 06.02.2026, this Criminal Writ Petition was disposed of and circulated today on Production Board for compliance.

Mr. Nimeet Sharma, learned Advocate for the Petitioners states that Petitioners have obtained the Fixed Deposit Receipt for
an amount of Rs. 5,00,000/-.

Mr. Yashovardhan Dixit, learned Advocate for Respondent No. 2 tenders the required Affidavit-cum-Undertaking dated 21.02.2026 of Respondent No. 2-Balu Rajaram Shelke & his wife Mrs. Sapana Balu Shelke, who are the parents of victim, jointly affirmed by them before the Advocate Notary Mr. Udai Prakash, Malad (West), Mumbai alongwith a photostat copy of the Fixed Deposit Receipt alongwith a photostat copy of the Fixed Deposit Receipt. Same are taken on record and marked as "X-3" for identification. Affidavit-cum-Undertaking dated 21.02.2026 of the victim (Yash Balu Shelke), affirmed by him before the Advocate Notary Mr. Udai Prakash, Malad (West), Mumbai alongwith a photostat copy of the Fixed Deposit Receipt are taken on record and marked as "X-4" for identification.

Mr. Nimeet Sharma, learned Advocate for the Petitioners handovers the original Fixed Deposit Receipt of an amount of Rs. 5,00,000/- to the victim-Yash Balu Shelke in presence of Respondent No. 2 and Advocate Mr. Yashovardhan Dixit. VictimYash Balu Shelke admits and acknowledges the receipt of said Fixed Deposit Receipt from Advocate Mr. Nimeet Sharma. 6.
Mr. Nimeet Sharma, learned Advocate for the Petitioners submits that the intention of giving this additional compensation is to secure the educational prospects/needs of the victim-Yash Balu Shelke and therefore, the Petitioners having apprehension that there may be an attempt to encash the Fixed Deposit Receipt prior to its maturity, craves leave to address a letter to the Bank Manager
of the concerned bank with the copies of order dated 06.02.2026, this order and the Affidavits-cum-Undertaking dated 21.02.2026 (X-3 & X-4 respectively), so that the victim-Yash Balu Shelke will be able to take benefits of said Fixed Deposit Receipt only on the date of its maturity, i.e. 21.02.2032 and not prior to that. Permission granted.
