Heard the learned Counsel for the Petitioner. 2.

The challenge in this Petition is to an order dated 10 September 2025, whereby a proclamation has been ordered to be issued against the Petitioner. 3.

Learned Counsel for the Petitioner submits that, only bailable warrants were issued against the Petitioner and non-bailable warrant was never issued. However, the learned Magistrate has issued proclamation against the Petitioner. Attention of the Court was invited to the order dated 10 April 2023 (Exh.D) which indicates that bailable warrant was issued against the Petitioner. The reports of service also pertain to the bailable warrants issued against the Petitioner.

Learned Counsel for the Petitioner, on instructions, submits that the Petitioner will appear before the learned Magistrate. SSP 1/2

In view of the aforesaid facts, and having regard to the willingness of the Petitioner to appear before the learned Magistrate, the order of issuing proclamation stands quashed and set aside.

The Petitioner shall appear before the learned Magistrate on 6 May 2026.

In the meanwhile, the execution and operation of the bailable warrant shall remain stayed till 6 May 2026, on the condition that the Petitioner shall appear before the learned Magistrate on 6 May 2026. 8.

The Writ Petition stands disposed.
