Heard learned counsel for the Petitioner.

The challenge in this petition is to an order dated 4th February 2026 passed by the learned Special Judge, whereby an application preferred by the prosecution was allowed and witness, namely Girenlal Vyas, was permitted to be examined as a witness for the prosecution. 3.

The learned counsel for the Petitioner fairly submits that the said witness has already been examined. However, the grievance of the Petitioner is that, when Bail Application No. 2670 of 2025 was heard by this Court, a statement was made on behalf of the prosecution that only five witnesses remained to be examined. On the basis of that statement, this Court expedited the trial in the said case and directed that the trial Ajit 1/2

15-WP-819-2026.DOC be concluded preferably within a period of three months from the date of which the order dated 18th November 2025 in Bail Application No. 2670 of 2025 was placed before the learned Special Judge. Contrary to the said statement, the prosecution intends to examine more witnesses. 4.

As the witness has already been examined, there is no propriety in entertaining this petition. The Petitioner would, however, be at liberty to assail the order which may be passed by the learned Special Judge on such an application.

The petition stands disposed.
