The present Writ Petition is filed under Article 226 of the Constitution of India and Section 482 of the Code of Criminal Procedure, 1973/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking following reliefs: "(a) That this Hon'ble Court by invoking writ jurisdiction under Article 226 of the Constitution of India read with Section 482 of Criminal Procedure Code and Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 may issue appropriate writ, order and/or direction and quash and set aside the impugned First Information Report dated 2nd November 2023 bearing F.I.R. No.893/2023 registered with Lonikand Police Station, Pune City for the offences punishable under Sections 376(2)(n), 377, 323, 504 of Indian Penal Code and u/s. 3(1)(w)(i)(ii), 1/3

3(2)(Va) and charge-sheet dated 1st January 2024 along with Special Case No.60 of 2024 pending on the file of District Judge and Additional Sessions Judge, Pune.

(b) That pending the hearing and final disposal of the present writ petition, proceeding initiated and all further steps in respect of Special Case No.60 of 2024 pending on the file of learned District Judge and Addl. Sessions Judge, Pune against the petitioner may kindly be stayed. (c) For interim and ad-interim reliefs in terms of prayer (b) above may kindly be granted."

The present dispute arises out of the relationship between Petitioner and Respondent no.2. Due to certain disputes and differences between the parties, a First Information Report dated 2nd November 2023 bearing no.893 of 2023 was registered with the Lonikand Police Station, Pune at the instance of Respondent no.2. Subsequently, a charge-sheet bearing no.01/2024 dated 1st January 2024 came to be filed before the learned District Judge and Additional Sessions Judge, Pune in Special Case no.60 of 2024.

The parties have now amicably settled disputes amongst them and have no further grievance against each other. Respondent no.2 has filed an affidavit dated 9th December 2025 which records that Respondent no.2 has no objection to the quashing of the criminal proceedings in view of the amicable settlement reached between the parties and they further wish to put a quietus to the matter. 2/3

The learned advocates for the parties have submitted a self-attested copy of their clients' Aadhaar Card and the same along with the said affidavit dated 9th December 2025 shall form part of the record.

The Hon'ble Supreme Court in "Madhukar v. State of Maharashtra", 2025 SCC OnLine SC 1415 has held that the High Court can invoke its inherent power to quash criminal cases provided that the Court is satisfied that an amicable settlement has been reached, which serves the interests of justice. The parties have settled their disputes and a consent-affidavit has been filed to that effect. In light of the same, Writ Petition No.1091 of 2026 is allowed in terms of prayer clause (a) and the First Information Report bearing no.893 of 2023 registered with the Lonikand Police Station, Pune along with charge-sheet bearing no.1/2024 dated 1st January 2024 filed before the learned District Judge and Additional Sessions Judge, Pune in Special Case No.60 of 2024 and all the consequential proceedings arising therefrom stand quashed and set aside.
