These proceedings are recorded in accordance with the decision of this Court in Hema Suresh Ahuja and Others v/s. The State of Maharashtra and Another1, as the subject matter pertains to the offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Heard Ms. Swapana Kode, learned Advocate for the Petitioners and Mrs. Poonam Bhosale, learned A.P.P. for the State/Respondent.

By the present Petition, the Petitioners have sought for the following substantive reliefs in terms of prayer clause 9(b) :-

Gitalaxmi 12-WP-1138-2026.doc "b) This Hon'ble Court be pleased to issue an appropriate order and/or Writ by exercise its powers under article 226 of the Constitution of India and Section 528 of the Bharatiya Nagarik Suraksha Sanhita read to quash and set aside the First Information Report bearing C.R. No. 77 of 2026 registered with the Kalepadal Police Station, Pune under Sections 69 of the Bhartiya Nyaya Sanhita and Section 3(2) (V) The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 qua the Petitioners on such terms and conditions as this Hon'ble Court may deem fit." 4.

After having heard the matter for sometime, Ms. Swapana Kode, learned Advocate for the Petitioners, on instructions from the Petitioners craves leave to withdraw the present Petition unconditionally.

Request made by Ms. Swapana Kode, learned Advocate for the Petitioners is not objected by Mrs. Poonam Bhosale, learned A.P.P. for the State/Respondent.

In view of the statement made by Ms. Swapana Kode, leave granted to withdraw the present Criminal Writ Petition. 7.

Criminal Writ Petition No. 1138 of 2026 is dismissed as withdrawn.
