These proceedings are recorded in accordance with the decision of this Court in Hema Suresh Ahuja and Others v/s. The State of Maharashtra and Another1, as the subject matter pertains to the offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Heard Mr. Navkar Jain, learned Advocate for the Petitioner and Mrs. Anuja Gotad, learned A.P.P. for the State/Respondent. 3.
By the present Petition, the Petitioner has sought for the following substantive reliefs in terms of prayer clause 20(A) :-

After having heard the matter for sometime, Mr. Navkar Jain, learned Advocate for the Petitioner, on instructions from the Petitioner craves leave to withdraw the present Petition with liberty to file an application seeking discharge before the Trial Court at the appropriate stage.

Request made by Mr. Navkar Jain, learned Advocate for the Petitioner is not objected by Mrs. Anuja Gotad, learned A.P.P. for the State/Respondent.

In view of the statement made by Mr. Navkar Jain, leave granted to withdraw the present Criminal Writ Petition with liberty as prayed for.

If an Application seeking discharge is filed by the Petitioner before the Trial Court at the appropriate stage, the same be considered on its own merits and in accordance with law. 8.
Criminal Writ Petition No. 1144 of 2026 is dismissed as withdrawn.
