By the present Petition, the Petitioner has sought for the following substantive reliefs in terms of prayer clauses 3.8(A) to (C) :- "A.

That, this Hon'ble be pleased to restore the Criminal complaint no.4201/SS/2015 filed before the 43rd JMFC Court at Borivali, Mumbai u/s. 138 r/w 145 of the Negotiable Instruments Act, 1881 against the Respondent no.2. B.

That, this Hon'ble Court be pleased to set aside the order dated 19.07.2022 passed by the 43rd Ld. Judicial Magistrate of First Class, Borivali, Mumbai;

That, this Hon'ble Court be pleased to call for he records and proceedings of the 43rd Ld.JMFC, Borivali, Mumbai."

After having heard the matter for some time, Mr. Sunil Yadav, learned Advocate for the Petitioner, on instructions from the Petitioner, craves leave to withdraw the present Petition unconditionally.

Mrs. Poonam Bhosale, learned A.P.P. for the State/Respondent does not object for the request made by Mr. Sunil Yadav. 5.

In view of the statement made by Mr. Sunil Yadav, learned Advocate for the Petitioner, leave granted to withdraw the present Criminal Writ Petition.

Criminal Writ Petition No. 1168 of 2026 is dismissed as withdrawn.
