By the present Petition, the Petitioner has sought for the following substantive reliefs in prayer clause (a):- "A) That this Honourable Court be pleased to issue a writ mandamus or writ in the nature of mandamus or any other appropriate writ, direction and order under Article 226 and 227 of the Constitution of India, 1950 to be read with Section 529 of the Bharatiya Nagarik Suraksha Sanhita, 2023, directing the learned Additional Chief Judicial Magistrate [24th Court] Borivali, Mumbai, to hear the Case bearing C.C. No. 1921/PW/2018 on a day-to-day basis and to decide and dispose of the same, in a time bound manner, preferably within a period of six months."

Grievance of the Petitioner, a senior citizen (83 years of

age), is that the said proceedings initiated on her complaint are pending since the year 2018. He submits that the Petitioner (Complainant) has to appear before the Court for recording her statement. He submits that on account of the delay prejudice is caused to the Petitioner, of which undue advantage is derived by the accused. He submits that it is in the interest of the Petitioner that the proceedings in C. C. No. 1921/PW/2018 are disposed of expeditiously.

Ms. Pallavi Dabholkar, learned APP for the State, fairly, on instructions from the Investigating Officer present in Court, submits that the prosecution will expedite the proceedings in C. C. No. 1921/PW/2018. She submits that the prosecution will make an endeavour to examine all the witnesses in the said crime within a period of three months from today. She submits that the prosecution shall oppose the unnecessary adjournment request, if made, by Accused. She submits that the prosecution will make a request to the Additional Chief Judicial Magistrate [24th Court] Borivali, Mumbai, to expedite disposal of the said proceedings, considering the Petitioner (complainant) who is a senior citizen.

On the basis of the said statement made by Ms. Pallavi Dabholkar, learned APP for the State, Mr. Sandeep Phatak, learned Advocate for the Petitioner, submits that the grievance of the Petitioners is redressed. He therefore requests for disposal of this Petition.
