By the present Petition, the Petitioner has sought the following substantive relief :- "(a) That this Hon'ble Court be pleased to issue appropriate order, writ, order in favour of the petitioner and may kindly quash and set aside proceeding pending before the Ld. Magistrate as SCC No.7865 of 2024 pending before the Ld. Judicial Magistrate First Class, at Panvel, Dist : Raigad. Pursuant to bearing CR No.318/2024 Registered by Kalamboli Police station for the commission of offenses u/s 281, 125(a), 125(b) of Bhartiya Nyay Sanhita, 2023 and u/s 184 of Motor Vehicles Act, 1988, on such terms as this Hon'ble Court may deem fit and proper"

After having heard the matter for some time, Mr. Vinod Kendre sought a pass over. At his request, this matter was taken up after some time.

Mr. Vinod Kendre, learned Advocate for the Petitioner, on instructions from the Petitioner, craves leave to withdraw the present Petition with liberty to file an application seeking discharge before the Trial Court.

Ms. Pallavi Dabholkar, learned APP for the Respondent/State, does not object to the request made by Mr. Vinod Kendre, learned Advocate for the Petitioner. 6.

In view of the statement made by Mr. Vinod Kendre, learned Advocate for the Petitioner, leave granted to withdraw the present Petition with liberty as prayed for. If an application seeking discharge is filed before the Trial Court at the appropriate stage, the same be considered on its own merits and in accordance with law.

Criminal Writ Petition No.1353 of 2026 is disposed of as withdrawn.
