By the present Writ Petition, the Petitioner is seeking to quash First Information Report bearing Crime No. 60 of 2026 for the offences punishable under Sections 123, 223, 275 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 along with Sections 26(2)(i), 26(2)(ii), 26(2)(iv), 27(2)(e), 30(2)(a) & 59 of the Food Safety & Standards Act, 2006 registered with Bhayandar Police Station,
dated 16.02.2026.

Mr. Nehal Desale, learned Advocate for the Petitioner submits that the issue involved in the present Petition is pending for consideration before the Hon'ble Supreme Court. He further submits that similar issues are involved in Criminal Writ Petition Nos. 280 of 2025, 3444 of 2025 and 4078 of 2025. He refers to the orders passed in the above said Petitions, wherein this Court has admitted the same and granted interim reliefs. 4.
Ms. Rajeshree Newton, learned APP for the Respondent - State does not dispute that the issue involved in the present Petition is subject matter of the Petitions, referred by the Petitioner in the present Petition. She submits that the present Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS") be tagged along with the aforesaid Petitions.

Mr. Nehal Desale, learned Advocate for the Petitioner submits that the interim orders granted in the aforesaid Petitions, be also granted in this Petition.

Ms. Rajeshree Newton, learned APP for the Respondent - State does not object to the said request.

In view of the above, further proceedings arising out of Crime No. 60 of 2026 registered with Bhayandar Police Station, dated 16.02.2026 are stayed qua the Petitioner. 8.
