Heard Mr. Ninad Bnabal, learned Advocate for the Petitioner and Ms. Rajeshree Newton, learned APP for the State. 2.

The limited request made by the Petitioner in the Petition is for a direction to the Court of the Additional Sessions Judge, Dindoshi (Borivali Division), to consider and dispose of the Applications filed by the Petitioner at Exhibit Nos. 8 & 9 in Sessions Case No. 406 of 2022.

Mr. Ninad Bnabal, learned Advocate for the Petitioner submits that the Application at Exhibit-8 is an Application seeking discharge (page No. 191 to 198 of the paper book) whereas the Application at Exhibit-9 is an Application for return of property (page No. 191 to 192). He submits that both Applications have been pending since February, 2024.

Ms. Rajeshree Newton, learned APP for the State, submits that apparently the Petitioner has not brought the pendency of the said Applications to the notice of the Additional Sessions Judge, Dindoshi (Borivali Division) and therefore, the said Applications have remained undecided.

Be that as it may, if the Application at Exhibit-8 and the Application at Exhibit-9 on the file of Sessions Case No. 406 of 2022 are pending since the month of February 2024, the learned Additional Sessions Judge, Dindoshi (Borivali Division), is directed to consider and dispose of the same, expeditiously, on its own merits and in accordance with law.

Mr. Ninad Bnabal, on instructions from the Petitioner, states that the Petitioner shall cooperate in the disposal of the Applications and will not seek any unnecessary adjournment. He further states that this order will be placed before the Additional Sessions Judge, Dindoshi (Borivali Division), on the next date fixed in Sessions Case No. 406 of 2022.
