Heard Mr. Amit Katarnaware for the Petitioner and Ms. P. P. Bhosale for the State.

By the present Petition, the Petitioner has sought for the following substantive relief;

(a) This Hon'ble Court is pleased to quash and set aside criminal proceedings pending under investigation against the Petitioner arising out upon the C.R. No. 510 of 2025 registered at Dharavi Police Station Mumbai u/s 316(2), 351(3) of Bharatiya Nyaya Sanhita 2023.

(b) This Hon'ble Court is pleased to quash and set aside the chargesheet which is registered via Police Case

2222/PW/2025 before the Ld. JMFC, Bandra.

(c) This Hon'ble Court is pleased to quash and set aside the Order dated 18/09/2025 taking cognizance of the offence by the Ld. JMFC, Bandra arising out of C.R. No. 510 of 2025 registered at Dharavi Police Station for the offence punishable u/s 316(2), 351(3) of the BNS.

(d) This Hon'ble Court is pleased to pass appropriate orders for maliciously, vexatiously, arresting the Petitioner in arbitrary manner by providing compensation to the Petitioner and to direct departmental and penal proceeding against the concern police officers to prevent the abuse of process of Law and to secure the end of Justice. 3.

After having heard the matter for some time, Mr. Amit Katarnaware, learned Advocate for the Petitioner, on instructions from the Petitioner, seeks leave to withdraw the present Petition with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage. Request made by Mr. Amit Katarnaware, learned Advocate for the Petitioner is not opposed by Ms. P. P. Bhosale, learned APP for the State. 4.

In view of the statement made by Mr. Amit Katarnaware, learned Advocate for the Petitioner, leave granted to withdraw the present Petition with the liberty as prayed. If an Application seeking discharge is filed before the Trial Court at the appropriate

stage, the same be considered on its own merit and in accordance with law.

Criminal Writ Petition No. 1769 of 2026 is disposed of as withdrawn.
