Heard the learned counsel for the parties.

The challenge in this Petition is to an order dated 17th March 2026 passed, by the learned Additional Sessions Judge, Pune, whereby Respondent No.1-Complainant has been permitted to assist the prosecution and advance oral submissions on the discharge application, subject to the control of the Court and without affecting the primary ARUN RAMCHANDRA SANKPAL role of the Public Prosecutor.

This Court is informed that the Petitioners-Accused have already concluded their submissions. The learned Special Prosecutor has also advanced his submissions. The matter is posted before the learned Magistrate tomorrow.

Mr. Salunke, learned counsel for Respondent No.1-Complainant, on instructions, submits that Respondent No1-Complainant will advance submissions tomorrow and will not seek any adjournment. 5.

In view of the aforesaid development, and the submission on behalf of Respondent No.1-Complainant that Respondent No.1Complainant will advance submissions on the discharge application tomorrow, there appears a reasonable prospect of the discharge application being decided by the same learned Judge who has heard the submissions on behalf the Petitioners-Accused and the learned Special Public Prosecutor, if Respondent No.1-Complainant advances his submissions tomorrow.

The Petition, thus, stands disposed with a direction to Respondent No.1-Complainant to advance oral submissions tomorrow before the learned Magistrate.

The learned Magistrate is requested to allocate some time tomorrow for the submissions on behalf of Respondent No.1Complainant, and, thereafter, decide the discharge application as expeditiously as possible, and, preferably, before the Court closes for vacation.
