By the present Petition, the Petitioner has sought for the following relief in terms of prayer clause (b) :- (b) by appropriate writ, order or direction, this Hon'ble Court be pleased to quash and set aside the order dated 13.11.2018 passed below Exhibit 12 by Ld. Session Judge, Bhiwandi in Session Case No. 1257 of 2023 arising out of C.R. No. I-04 of 2016 registered with Bhiwandi Taluka Police Station, for the offence punishable under section 302 of IPC, 1860 Thane on such terms and conditions;

After having heard the matter for some time, Mr. Rushikesh learned Advocate for the Petitioner, on instructions from the Petitioner, seeks leave to withdraw the present Petition. 3.

Mr. Sukanta Karmakar, learned APP for the Respondent - State, does not oppose to the request made by Mr. Rushikesh Kale, learned Advocate for the Petitioner.

In view of the statement made by Mr. Rushikesh Kale, learned Advocate for the Petitioner and the no objection given by Mr. Sukanta Karmakar, learned APP, leave is granted to withdraw the present Petition.
