The challenge in this Application is the order passed below Exhibit-1 by learned Additional Sessions Judge, Nashik dated 21.02.2026. 2.

It is contention of learned counsel for the applicant that the trial Court has given no objection for renewal of the passport of the applicant but the Trial Court has directed the applicant to take written permission of the Trial Court before going to abroad. He further submitted that earlier this Court had permitted the applicant to inform Upnagar Police Station, Nashik while going abroad. The applicant will inform the Investigating Officer before going abroad and provide itinerary of his travel and

requested to allow the application.

Learned APP objected to allow the application on the ground that the Trial Court has passed well reasoned order. No interference is required in it and requested to reject the application. 4.

I have heard both the learned counsel. Perused impugned order. While allowing the bail application of the applicant, the Trial Court has imposed condition No.3 that "The applicant shall submit his renewed passport, within 3 days from the date of renewal, in concern police station and shall not travel abroad without written permission of this Court." In my view, when the Trial Court is asking for permission of Court before going to abroad, it is not necessary to direct the applicant to deposit the passport before the police station after its renewal and I pass following order.

ORDER

(i) The condition No.3 of order dated 21.02.2026. imposed by the Trial Court is modified as under:

"The applicant shall not deposit the passport before the police station but applicant shall take permission of the Trial Court before going abroad. If applicant files application to travel abroad, the Trial Court shall decide it within two weeks. The concerned police authority shall return the passport of the

applicant if he has deposited."

Revision Application is allowed and disposed of. All pending applications, if any, also disposed of.
