Having heard for some time, it appears that as per record of the Jail Superintendent, petitioner has not attained the age of 65 years to grant him benefit of the Government Resolution dated 10/01/2006.

The counsel for petitioner submits that she has obtained Transfer Certificate from Zilla Parishad School at Akola, where the applicant had taken education. The Transfer Certificate shows that his date of birth is 23/08/1960 and thus, he is above 65 years. This document, however has been not furnished to the Jail Authority and therefore, respondent No.4 - Superintendent of Jail is unaware of correct status of date of birth of the petitioner.

That being so, the purpose of filing petition will be served, if the petitioner is directed to furnish the
2 14-CRI-WP-14-2026.odt document i.e. Transfer Certificate to the respondent No.4 - Jail Authority, who shall then verify the correctness of the document and proceed to decide the application filed by the petitioner in accordance with the Government Resolution dated 10/01/2006 or any other Resolution / Policy, as applicable to the case.

In above terms, petition is disposed of.
