The petitioner is aggrieved by the inaction on the part of respondent No.3 in not lodging an F.I.R. The learned Counsel for the petitioner submits that the issue involved in the present petition is covered by the judgment of this Court in the case of Dr. Jayant Vasantrao Awchar vs. State of Maharashtra and Ors. in Criminal Writ Petition No.169/2023 along with connected petition.

On the strength of the submissions so made by the learned Counsel for the petitioner, which we will test in due course, issue notice to the respondents, returnable on 28th January, 2026. 04.

The learned A.P.P. waives notice on behalf of respondent No.1/State.
