: ANIL L. PANSARE & NIVEDITA P. MEHTA, JJ.
DATE : 27 th JANUARY, 2026.
The argument is that surety furnished by the petitioner has been not accepted on the ground that he does not possess immovable property. 02.
The learned Counsel for the petitioner submits that the issue of solvency depends upon the capability of the surety to pay the surety amount and not necessary on owning or possessing immovable property. In a given case, a salaried person can be treated as a solvent surety even without having any immovable property to his credit.
03.
Issue notice to the respondents, returnable on 3rd February, 2026.
04.
The learned A.P.P. waives notice on behalf of the respondents/State.
