Petitioner has approached this Court with following prayers:

"1.

Declare the action of holding the vehicle bearing registration no.MH 31 DS 1464 of petitioner by the respondent no.3 and 4 after releasing order passed by the Judicial Magistrate First Class Motor Vehicle Court Nagpur and also after the dismissal of complaint filed by the respondent RTO in respect of this vehicle before the learned trial Court, is arbitrary, illegal and without jurisdiction.

Direct the respondent no. 3 the Regional Transport Officer, Nagpur (Rural) and respondent no. 4, the incharge of Wardhman nagar Aagar (S. T. Deport) Nagpur to release and hand over the vehicle bearing registration no. MH 31 DS 1464 of the petitioner to him. 3.

Direct the respondent no. 3, the Regional Transport Officer, Nagpur (Rural) to pay damages Rs. 10,000/- per day for illegal detention of this vehicle from the date of dismissal of complaint of this seizure vehicle bearing registration no. MH 31 DS 1464 of petitioner i.e. from 27/04/2023 which was filed by him before the Judicial Magistrate first Class Motor Vehicle court Nagpur."

Respondent No.3 is present. He submits that vehicle under question will be released today.

The petitioner shall approach respondent No.3 by 05:30 p.m. today and after completing the formalities, the vehicle shall be released by respondent Nos.3 and 4. So far as damages is concerned, we grant liberty to the petitioner to file appropriate proceedings against the respondents, if so advised. 4.

The writ petition is disposed of.
