The petitioner-convict seeks a direction to process his case for extending the benefit in terms of communication dated 16/11/1978, issued by the Deputy Secretary to the Government of Maharashtra, Home Department. The said communication lays down guiding principles indicating a broad division of the pattern of crimes for the purpose of premature release of prisoners sentenced to imprisonment for life. 02.

The grievance of the petitioner is that, despite such guidelines existing, the respondents have not processed his case for premature release in terms of the said communication.

As such, we are of the view that the directions, as sought, are not necessary, as the respondents are duty-bound to process the case of every convict who is otherwise entitled to the benefit under the aforesaid communication.

The learned A.P.P. shall take instructions as to why was the petitioner's case not processed in terms of the aforesaid communication. For that purpose, issue notice to the respondents, returnable on 7th March, 2026.
