Learned Additional Public Prosecutor (APP) waives service of notice for the respondent.

The argument is that though the issue is settled by the Division Bench of this Court at Aurangabad Bench in Criminal Writ Petition No. 332/2025, the respondent insisted the prisoner to furnish surety instead of dispensing with the surety bond.

Learned APP shall take instructions and respondent shall justify the impugned order in the light of law laid down by this Court in afore-mentioned Criminal Writ Petition No. 332/2025.
