The argument is that despite disclosing offence in the report lodged with respondent no. 1, the action under Section 154 of the Code of Criminal Procedure, 1973 [presently, under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') has not been taken. If that be so, the petitioner has alternate and efficacious remedy under Section 173 of the BNSS, which the petitioner may avail.
With the aforesaid liberty, the petition is disposed of.
