By this petition, the petitioner is seeking extension of the parole leave for a further period of twenty-five (25) days commencing from the date of expiry of the current parole period to enable the petitioner to attend the petitioner's daughter marriage and to make necessary financial and logistical arrangements for his household.

As per the contention of learned counsel for the petitioner he is undergoing imprisonment over 12 years for the offence punishable under section 302 of the Indian Penal Code. The petitioner has been convicted by the learned Court of Session, Gadchiroli on 24.09.2009. Respondent has granted regular parole to the petitioner for fifteen days and ordered his release upon the compliance with all terms and conditions on 08.04.2026. The petitioner has made an application for grant of regular parole for a period of forty days to attend the marriage of his daughter, however, the respondent granted regular parole for only fifteen days. He has also filed an application with the respondent seeking an extension of parole for twenty five days on 30.03.2026 which remains pending with the respondent and therefore he approached to this Court. 4.
The respondent has considered the request of the petitioner for grant of regular parole, for the reason that he has to attend the marriage of his daughter and accordingly paraole was granted for fifteen days. 5.
In view of the Rule 13 of the Maharashtra Prisons (Furlough and Parole) Rules, 2024, which is reproduced as under:
13. Types of parole:
The parole is of following two types, namely:-
(1) Regular Parole - Regular parole may be granted to prisoner to attend serious illness of his spouse or blood relatives, birth of his child, marriage of his children or siblings or the aftermath of natural calamities like floods, fire, earthquake resulting in damage to his house and property.

(2) Emergency Parole - Emergency parole may be granted to prisoner to attend the final rituals on the death of his spouse or blood relatives. 6.
The marriage of the daughter of the petitioner was already performed on 21.04.2026. He has also attended the marriage. Wedding card which is also placed on record shows that the marriage was performed on 21.04.2026. Thus, the reasons mentioned in the application were also considered by the respondent and now the petitioner seeks extension of parole. 7.
In view of the Rule 18 of the Maharashtra Prisons (Furlough and Parole) Rules, 2024, parole shall not be extended beyond the sanctioned period under any circumstances.
