DATE :

06.05.2026.

Heard the learned Counsel appearing for the parties.

2.

By way of this petition, the petitioner is challenging the judgment and order dated 19.01.2026 passed by the Additional Sessions Judge Court No.3, Amravati in Criminal Bail Application No. 47/2026 to the extent of imposing condition no.(V) by which the petitioner was directed to not leave the local jurisdiction of the Court without permission of the Court till the conclusion of the Trial.

3.

Learned Counsel for the petitioner submits that after passing of the impugned order the petitioner has complied with all the conditions imposed by the Trial Court, however as the petitioner is required to go beyond local jurisdiction for his regular work, he is finding it difficult due to the aforestated condition imposed by the Sessions Court. For the relaxation of the same, the petitioner has filed an application before the Trial Court bearing no.OMCA No.44/2026 on 18.03.2026, however till today there are no orders and

2 19.cri.wp.365.2026 therefore, alternatively, the petitioner is prayed to direct the Trial Court to decide the same.

4.

Considering the limited prayer made, I find no hurdle to decide the present petition. Hence, the following order :

(a) The petition is partly allowed.

(b) The District Judge-1 and Additional Sessions Judge, Amravati shall decide OMCA No.44/2026 after giving an opportunity to the State, within one week from the date of receipt of this order. 5.

With these observations, the petition stands disposed of accordingly.
