The applicant is seeking bail in respect of offence bearing Crime No.917 of 2025, registered with Newasa Police Station, District Ahilyanagar, for the offences punishable under Section 143 of B.N.S. and Sections 3, 4, 5, 7, 8 of Immoral Traffic (Prevention) Act.

It is alleged that applicant is the owner of lodge where the illegal activities were being conducted in collusion with other persons. He is arrested on 30.10.2025. Charge-sheet is filed on 19.12.2025.

Learned counsel for the applicant submits that the ingredients of Sections 3, 4, 5, 7 and 8 of the Immoral Traffic

(Prevention) Act, 1956 as well as Section 143 of B.N.S. Act are not attracted. There is no prima facie case and further detention is illegal.

Per contra, learned APP submits that there is clinching material on record to show involvement of the applicant in a serious offence. The statements of the victims would indicate that the illegal activities were going on in the lodge owned by the applicant. He is actively participated in the commission of offence.

I have gone through First Information Report and the statements of the victims recorded during the course of investigation. Applicant is the owner of lodge in question. No criminal antecedents are reported against the applicant. He is behind bar since 30.10.2025 which is a sufficient incarceration. The investigation is also over.

The solemn statement has been made by the learned counsel appearing for the applicant that his client would not indulge in the illegal activities as alleged against him in future. There is no reason to discard the submission. Hence, I pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant BALASAHEB BHANUDAS JADHAV shall be released on bail in respect of Crime No.917 of 2025, registered with Newasa Police Station, District Ahilyanagar, for the offences punishable under Section 143 of B.N.S. and Sections 3, 4, 5, 7, 8 of Immoral Traffic (Prevention) Act on furnishing P. R. bond of Rs.50,000/- (Rupees fifty thousands only) with one solvent surety of like amount on the following conditions :

(a) The applicant shall not tamper the prosecution evidence and the witnesses.

(b) The applicant shall not indulge in similar type of activity in future.

(c) The applicant shall co-operate the Investigating Officer for furnishing any information, if required.

(iii) Bail application is disposed of accordingly.
