Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 136/2025 registered with Bhokardan Police Station, Dist. Jalna for the offences punishable U/Sec. 109, 115, 351(2), 351(3) of the Bhartiya Nyay Sanhita. 2.
Applicant was arrested on 26.03.2025. Charge sheet was filed on 23.05.2025. I have gone through the first information report, statements of the eye witnesses, injury certificate and relevant papers. The applicant is alleged to have assaulted his wife, who is informant in broad day light on 24.03.2025 at 7.30 AM in a private hospital located at Bhokardan. Informant is looking after their son, who was ill and hospitalized since 22.03.2025. Applicant is stated to have been addicted to liquor
2 914 ba 59.26 and frequently demanding money. Medico legal certificate shows injuries are grievous in nature.

I have gone through the statements of eye witnesses Rahul Deelip Sahane and Dr. Yogita Ravindrakumar Wagh, who were present at the relevant time. Applicant was seen assaulting his wife in the hospital. The medical certificate corroborates the prosecution theory. In such a situation long incarceration cannot be a ground to enlarge the applicant on bail. 4.
Applicant is a person addicted to liquor and he did not bother even to assault his own wife in broad day light. I find that enlarging the applicant on bail would endanger life of the informant as well as minor son. Bail application is rejected. 5.
For the assistance rendered by learned counsel Mr. Chaitanya Dharurkar, who is appointed through Legal Aid, remuneration would be quantified as per law and rules. [ SHAILESH P. BRAHME J. ] bsb/March 26
