The applicants are seeking regular bail in connection with Crime No. 247/2025, registered with Ramanand Nagar Police Station, District Jalgaon for the offences punishable under Sections 96, 64, 64(2)(m), 351(2), 3(5) of Bharatiya Nyaya Sanhita, 2023, under Section 4,8,12 of The Protection of Children from Sexual Offences (POCSO) Act, 2012, and under Section 9, 10 of Prohibition of Child Marriage Act.

The applicants are facing allegations that they are part of a racket of bogus matchmaking for solemnizing the marriages. The informant, who was fallen prey, approached the police contending that taking disadvantage of her financial condition she was dragged by the applicants and others to become part of their group, which was indulging in deceiving innocent people and extracting amounts and ornaments from them under the pretext of marriages. She was forced to marry with co-accused Ashish, when she was minor. The accused extracted two lakh rupees and gold ornaments from Ashish and his parents who are from village Thergaon, Kolhapur. It is alleged that she was constrained to keep physical relations with Ashish. The absconding accused Sujata and Akshay collected the amount and ornaments and fled away. The victim was alleged to have impregnated and later on resorted to abortion.

The applicant Meena was arrested on 10.07.2025 and Manisha was arrested on 11.07.2025. The charge-sheet is filed on 21.01.2026. In the present application, the respondent-informant has filed affidavit in reply supporting the applicants.

Counsels appearing for the applicant would submit that the informant has no objection for releasing them on bail. There is sufficient incarceration. The co-accused Sujata and Akshay are the main culprits. There is no material available against the applicants attributing any specific role. It is contended that applicant Meena was not even present for conducting talks of marriage and actual wedding ceremony.

Learned A.P.P. Mrs. Diggikar appearing for the respondent/State has contested the submissions by pointing out papers of investigation. The supplementary statement of informant, statement of mother of informant, Janvi, Kajal and the medical papers showing termination of pregnancy are pointed out to show involvement of the applicants. The applicants are stated to be antecedents against them. The informant/victim is stated to be minor at that time.

I have gone through the first information report, supplementary statement of informant, statement of mother of informant, Janvi and Kajal. It cannot be said that there is no involvement of both the applicants. But it reveals that amount and the ornaments have been collected by absconding co-accused Sujata and Akshay. They appear to be mastermind. Applicant Manisha has two antecedents. Applicant Meena has one antecedent. 8.
The respondent-informant has filed affidavit, as she is major at the time of filing of the affidavit. She has no objection for releasing the applicant on bail. The investigation is over and there is sufficient incarceration for the ladies.

The counsels appearing for the applicants have stated that the 3/5
applicants are married and are resident of Jalgaon. They are ready to abide by any conditions. They have voluntarily agreed to deposit amount before Trial Court. On instructions of the clients, both the counsels have made candid statement that each one of them is ready to deposit Rs. 50,000/- before the Trial Court within stipulated period. 10.
Considering the overall circumstances of the matter, I find that if the applicants have voluntarily accepted to deposit an amount of Rs. 50,000/- each, then that would curtail their incriminating tendencies. In that view of the matter, I am inclined to grant them bail. 11.
The Bail Applications are allowed.

The applicants Mrs. Manisha @ Minakshi Dinesh Jain and Meena Prakash Borse, shall be released on bail in connection with Crime No. 247/2025, registered with Ramanand Nagar Police Station, District Jalgaon for the offences punishable under Sections 96, 64, 64(2)(m), 351(2), 3(5) of Bharatiya Nyaya Sanhita, 2023, under Section 4,8,12 of Prevention of Children from Sexual Offences Act, and under Section 9, 10 of Prohibition of Child Marriage Act. on following conditions:
(a) The applicants shall furnish P.R. bond of Rs. 20,000/- (Rs. Twenty Thousand only) each with one solvent surety each of like amount.
(b) The applicants shall not tamper with prosecution evidence or contact with the prosecution witnesses. (c) The applicants shall furnish their mobile/cell number and address to the investigating officer. (d) The applicants shall deposit amount of Rs. 50,000/-(Rs.Fifty Thousand only) each before the Special Court Jalgaon District Jalgaon in Spl Case No. 360/2025 on 4/5
or before 28.04.2026. If the amount is not deposited within stipulated period the bail granted today shall stand cancelled automatically without further reference to this Court.
(e) Out of the amount deposited, 50% of the amount i.e. Rs. 50,000/- (Rs. Fifty Thousand only) shall be disbursed by the learned Special Judge to respondent no. 3. (f) The applicants shall surrender their Aadhar Cards and PAN cards to the investigating officer.
(g) The applicants shall cooperate for expeditious disposal of the trial.
(h) The applicants shall inform their whereabouts to the investigating officer and shall not leave Jalgaon district without intimation to the investigating officer. 13.
Bail applications are disposed of.
