The applicants has approached this Court seeking regular bail in connection with FIR dated 26.09.2025 bearing Crime No. 258 of 2025 registered with Neknoor Police Station, Dist. Beed for the offences punishable under Sections 118(2), 115(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2.
The case of the prosecution is that on 21.09.2025 approximately at 09.00 am, the informant, Ashok Kisan Mane, and his brother, Amol, were returning from their agricultural field near the village tower in Patoda Belkhandi. They were intercepted by Chandrakant Murali Bage, Vikas Vishnu Savashe and Sindhu Chandrakant Bade, who confronted them regarding a prior dispute.
-2Vikas Savashe initiated the confrontation by verbally abusing the brothers and claiming they needed to be punished, subsequently leading to a physical assault involving kicks and blows. 3.
The altercation escalated into a violent attack when the brothers attempted to resist the abuse. Chandrakant Bage used an iron rod to strike Ashok on the head and both shoulders, while Vikas Savashe stabbed Amol in the head with a knife. As both victims were bleeding, Sindhu Bage further assaulted them, specifically targeting their eyes. The three assailants then pinned the brothers to the ground and threatened that if they pursued legal action, they would be attacked with swords and eliminated. The situation was eventually halted by the intervention of others present.

The learned counsel for the applicant submits that the applicants have been falsely implicated in the offence due to an admitted long-standing agricultural dispute. The prosecution's narrative regarding the incident dated 21.09.2025 is a calculated exaggeration of a minor scuffle. Hence, it is prayed that the application be allowed.

The learned APP opposed the application, submitting that the offence is serious in nature and there is sufficient material on record to establish the applicants' complicity. Furthermore, the APP argued that if the applicants are released on bail, there is every possibility of the prosecution evidence being tampered with or the offence being repeated. Accordingly, it was prayed that the application be rejected.

Upon considering the submissions of both sides and perusing the material on record, including the charge-sheet, the prosecution alleges that a violent assault occurred on 21.09.2025 involving an iron rod and a knife. However, the medical certificate indicates that the informant, Ashok Kisan Mane, was discharged from the Government Hospital on 23.09.2025, after the alleged incident.

The short duration of hospitalisation prima facie indicates that the injuries sustained do not prima facie align with the gravity of an attack involving lethal weapons as described in the complaint. The recovery of the weapons is already complete, and as the investigation is primarily based on medical documentation, the custodial interrogation of the accused is no
-4longer deemed essential.

Moreover, the arrest of the applicants is effected on 01.01.2026 and since then, they are in jail. As such, further incarceration of the applicant as an under trial prisoners, in the circumstances of the case, does not seem to be either warranted or justifiable. I am, therefore, persuaded to exercise the discretion in favour of the applicants.

Hence, the following order:
ORDER
(I) The Bail Application is allowed.
(II) Applicants - Chandrakant Murlidhar Badge and Vikas Vishnu Sawase be released on regular bail on furnishing P.R. bond of Rs. 50,000/- (Fifty Thousand Only) each with one or two local solvent sureties in the like amount, in Crime No. 258 of 2025 registered with Neknoor Police Station, Dist. Beed for the offences punishable under Sections 118(2), 115(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :- (a) The applicants shall attend each and every date of the Trial Court unless exempted by the Trial Court.
-5- (b) The applicants shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.
(c) The applicants shall submit his Aadhar and Pan Card to the Investigation Officer and detailed addresses and phone numbers of applicant and two of the near relatives.
(d) Breach of any of the conditions by the applicants would entail the cancellation of the bail.
(iii) Needless to states that the observations rendered herein are to the extent of this application and the trial court shall not be influenced by the same. (SACHIN S. DESHMUKH, J.) Omkar Joshi
