FINAL ORDER:- 1.

The applicant seeks regular bail in Crime No.33 of 2025 dated 19.01.2025 registered with Ramanand Nagar Police Station, Taluka and District Jalgaon for the offences punishable under Section 103(1), 109, 118(2), 324(4), 189(2), 191(2), 191(3), 190, 61(2), 238 of Bharatiya Nyaya Sanhita, 2023 a/w 4/25 of Indian Arms Act. 2.

The investigation was set in motion on the basis of information given by Sonu Ramesh Shirsath. In short, it is alleged that her brother Mukesh was assaulted by accused persons. He received fatal injuries due to blow by scythe, chopper on neck and lost his life.

(2) The accused persons also attacked and caused injuries to other family members. It is alleged that since Mukesh had love marriage with Pooja against wish of her family, accused persons attacked him and others. The investigation progressed. The applicant came to be arrested on 03.04.2025. The charge sheet came to be filed on 17.04.2025. The applicant moved Sessions Court for grant of regular bail. However, his application came to be rejected vide order dated 23.12.2025. 3.

Mr. A.K. Bhosale, learned advocate appearing for applicant submits that there is no iota of evidence against applicant to show his involvement in offence. His name has been falsely implicated. No recovery of weapon is made from applicant. The allegations in FIR are concentrated against accused nos.1 and 2. The general and omnibus allegations are made against other accused persons. 4.

Learned APP strongly opposed application saying that a brutal, preplanned murder has been caused by accused persons. They caused unlawful assembly. The offences are punishable under Section 302 r/w 147, 149 of Indian Penal Code.

Having considered submissions advanced, prima facie, it can be observed that applicant has been named in FIR. The applicant and other accused persons formed unlawful assembly. They were holding deadly weapons in their hands. The applicant was holding iron rod in his hands. One of the accused inflicted injury using chopper on neck of deceased Mukesh. He succumbed to injuries. The

(3) other accused persons attacked family members of Mukesh. They have received multiple injuries. The intention behind attack was love marriage of Mukesh with Pooja. The accused persons are belonging to family of Pooja. The statement of eye witnesses namely Komal Nilkanth Shirsale, Sunny @ Aryan Nilkanth Shirsath, Karan @ Hitesh Nilkanth Shirsath have specifically named applicant and stated about his presence on spot along and participation with iron rod. Prima facie, involvement and active role of applicant is discernible in commission of offence. Hence, no case is made out for grant of bail. Hence, application stands rejected.
