Learned counsel for the applicants submits that the applicant were arrested on 28.01.2026 and have remained in custody since that date. In order to attend a marriage ceremony scheduled on 03.02.2026 and 04.02.2026 at Ahmedabad, Gujarat, in their capacity as the elder brothers of the bride, the applicants prayed for release on temporary bail.
The applicants initially sought temporary bail from the
concerned Magistrate. Following a hearing, the learned Magistrate rejected the applications by an order dated 27.01.2026. Thereafter, the applicants approached the Sessions Court on 28.01.2026. Although the applications were heard and reserved for orders on 29.01.2026, however, no order has been passed till today.

The learned A.P.P. opposes the application, citing the gravity and severity of the alleged offence.

In view of the peculiar circumstances, since the marriage ceremony of the sister of the applicants is scheduled to be held on 03.02.2026 and 04.02.2026, the applicants' physical presence is essential to perform the necessary religious rituals associated with the occasion. As such, prayed for the release of the applicants on temporary bail.

Considering that the marriage ceremony is scheduled for 03.02.2026 and 04.02.2026, I am inclined to exercise discretion on humanitarian grounds to enable the applicants to attend and participate in marriage of their sister. As such, the request warrants consideration to grant temporary bail till 06.02.2026. 8.
Applicants, Surjit Janu Patro and Arun Balkrushna Shahu, shall be released on temporary bail in connection with Crime No.631 of 2025, dated 28.10.2025, registered at MIDC CIDCO Police Station, Chhatrapati Sambhajinagar, for the offences punishable under Sections 318(4), 319(2), 336(2), 340, 351, 61(2),
62 of the Bharatiya Nyaya Sanhita, 2023, Sections 66(c), 66(b) and 66(e) of the Information Technology Act and Sections 20 and 25 of the Indian Telegraph Act. This release is subject to the applicants furnishing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) each, along with one or two local solvent sureties in the like amount to the satisfaction of the trial Court with two police personal each at their own expenses, with copy of the Aadhar card and contact number of the relatives.

During the period of temporary bail, the applicants shall provide their detailed residential addresses and active mobile contact numbers to both, this Court and the concerned Police Station.

Furthermore, the applicants shall strictly refrain from influencing any prosecution witnesses or tampering with the evidence in any manner, directly or indirectly. 11.
Upon completion of the designated period, the applicants shall surrender themselves before the concerned Jail Authority on 07.02.2026. Any breach of these conditions shall entail the immediate cancellation of this temporary bail and further legal consequences.
