The applicant has approached this Court seeking regular bail in connection with FIR bearing Crime No.0199 of 2025 dated 13.05.2025 registered with Pundliknagar Police Station, District - Chhatrapati Sambhajinagar for the offences punishable under Sections 118(2), 126(2), 137(2), 140(2), 351(3), 352 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. In the said crime, the applicant is arrested 13.05.2025. Upon completion of the investigation, the chargesheet is filed.

Learned counsel for the applicant submits that general and sweeping allegations are levelled against the applicant and he was arrested on 13.05.2025 and the chargesheet has been filed. The informant and accused are close friends and reside in the same locality. There are no criminal antecedents. The applicant is falsely implicated in the crime. Co-accused No.2 Bhaskar has been

released on bail by this Court. Therefore, prayed to grant bail to the applicant on the ground of parity.

Learned APP has opposed the application submitting that the applicant is involved in a serious offence, as such, is not entitled for bail.

Upon considering the submissions of both sides and perusal of the record, including the chargesheet, prima facie, indicates that the co-accused Bhaskar Baburao Gaikwad, in Bail Application No.1665 of 2025, has already been released on bail by this Court, vide order dated 02.12.2025. Furthermore, the applicant aged 29 years is in custody since is his arrest on 13.05.2025. The necessary recovery is carried out by of the investigation agency. As such, investigation is complete and the chargesheet is filed. 5.

Considering the number of witnesses which the prosecution seeks to examine, the trial is unlikely to conclude within a reasonable period. Hence, I am inclined to exercise discretion in favor of the applicant. Any apprehension of the prosecution can be addressed by imposing stringent conditions to ensure his presence during the trial.

In that view of the matter, I am inclined to allow the application.

Hence, the following order:-

ORDER

(I) Application is allowed.

(II) Applicant, Akash Rameshwar Jadhav, be released on regular bail on furnishing P.R. bond of Rs. 50,000/- (Fifty Thousand Only) with one or two local solvent sureties in the like amount, in connection with Crime No. 0199 of 2025 dated 13.05.2025 registered with Pundliknagar Police Station, District - Chhatrapati Sambhajinagar for the offences punishable under section 118(2), 126(2), 137(2), 140(2), 351(3), 352 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :

(a) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

(b) The applicant shall submit his Aadhar and Pan Card to the Investigation Officer and detailed addresses and phone numbers of applicant and two of the near relatives.

(c) In case of breach of any of the conditions by the applicant, it is open for the Prosecution to move this Court seeking cancellation of bail.

(iii) Needless to states that the observations rendered herein are to the extent of this application and the trial court shall not be influenced by the same. [SACHIN S. DESHMUKH, J.] rrd
