The applicant seeks regular bail in connection with Crime No.883 of 2025 registered with MIDC, Latur Police Station, Dist. Latur for the offences punishable under Sections 109, 352, 351(2), 351(3) r/w 3(5) of BNS, us/4, 25 of the Arms Act.

The investigation was set in motion on the basis of information given by one Vishvanath Babalu Jadhav. In short, he alleges that he had joined business with his cousin namely Karan Mane. They had some dispute as regards to the business transactions. On 10.12.2025, his cousin called him on the pretext of settlement of dispute. He went
(2) near Talaf Pan Stall in Vasvadi area. He found his cousin Karan, one Anil and the applicant Babalu on the spot. His maternal aunt also arrived on the spot. The accused persons raised quarrel with him. Applicant Babalu and Anil assaulted him by kick and fist. His maternal aunt instigated Karan to raise assault on the informant. Accordingly, accused Karan inflicted blow of Katti (knife) on head and fingers. Eventually, he suffered grievous injuries. Lastly, Karan inflicted one more blow on left side of his stomach and threatened to kill. In pursuance to aforesaid information, crime no.883 of 2025 came to be registered for the aforesaid offences against in all four accused persons including applicant. The applicant has been arrested on 12.12.2025. Since then, he is behind bar. He made application for grant of regular bail before the Sessions Court, however, same has been rejected vide order dated 23.1.2026.

Heard Mr. Birajdar h/f Mr. Shinde, learned advocate appearing for applicant, Mrs.Diggikar, learned APP for respondent/state. 4.
Perused the contents of FIR. Apparently, it is a case of dispute between informant and his cousin Karan Mane on account of transactions of joint business. The narration of incident stipulates that applicant and one Anil gave fist and kick blows to informant. They were not holding any weapon in their hand. It is accused Karan Mane, who inflicted blow using knife on head, fingers and stomach of the informant.

Looking to limited role of applicant in commission of offence, further detention of the applicant would not be necessary. No criminal antecedents of applicant are brought to notice of this Court. He is a student aged about 18 years. Hence, case is made out to grant bail, subject to certain conditions. In result, following order is passed.
ORDER
(i) Bail Application is allowed.
(ii) The applicant, Bablu @ Rakesh s/o Shivram Gaikwad be released on bail in Crime No.883 of 2025 registered with MIDC Latur Police Station, District Latur for the offences punishable under Sections 109, 352, 351(2), 351(3) r/w 3(5) of BNS and u/s 4, 25 of Arms Act on furnishing P.B. and S.B. of Rs.50,000 (Rs.Fifty Thousand only) on following conditions :- a.
The applicant shall not tamper with the prosecution evidence in any manner.
b.
The applicant shall attend the concerned police station once in a week i.e. on every Monday between 11 am to 1 pm till filing of the charge-sheet.
c.
The applicant shall not indulge in criminal activity. (iii) Application is disposed of.
