2026:BHC-AUG:16348 941 BA 238 OF 2026.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 941 BAIL APPLICATION NO. 238 OF 2026 ROHIT ALIAS LAKKI RATAN SHILLAK
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER ...
Advocate for Applicant : Mr. Salunke Sudarshan J. APP for Respondents: Mrs. P. V. Diggikar ...
CORAM
: SHAILESH P. BRAHME, J.
DATE : 16.04.2026 PER COURT :
Heard both sides.
2.
The applicant is seeking enlargement on bail in connection with Crime No. 107/2024, registered with Kaij Police Station, District Beed, for the offences punishable under Sections 302, 120-B, 107 read with Section 34 of the Indian Penal Code.
3.
Learned counsel Mr. Salunke has candidly stated in the application that this is successive bail application and he could not succeed in earlier attempts. Those orders are also annexed to the application. 4.
Mrs. Diggikar, learned A.P.P. would point out that on earlier occasion while rejecting the application vide order 30.09.2025, this Court directed the Trial Court to conclude the proceedings within 12 weeks. The period is yet to be over and application at Exh. 16 was made before the Trial Court. It was rejected on 16.06.2025.
5.
Learned counsel Mr. Salunke submits that his client was arrested on 05.03.2024. Its a long incarceration and trial is yet to be concluded. The 1/2
941 BA 238 OF 2026.odt applicant is falsely implicated in the offence. His application needs to be entertained.
6.
Already the applicant had approached this Court and on merits no relief was granted which is evident from order dated 20.09.2024 passed in Bail Application No. 1461/2024. Thereafter, as per order dated 30.09.2025 passed in Bail Application No. 1237/2025 it was rejected with direction to conclude the trial within 12 months. The trial is underway. I do not find that there is any change in circumstances to permit the applicant to seek bail. The period stipulated by this Court is yet to be over. I find no merit in the application.
7.
Bail Application is dismissed.
