BENCH AT AURANGABAD 905 BAIL APPLICATION NO. 273 OF 2026 JAYDEEP DATTATRAY SURANKAR
VERSUS
THE STATE OF MAHARASHTRA ...
Advocate for Applicant : Mr. Wakale Vijay Shivaji APP for Respondent : Mr. N. R. Dayma ...
CORAM
: SHAILESH P. BRAHME, J.
DATE : 26.03.2026 PER COURT :
Heard both sides.
2.
The applicant is seeking regular bail in connection with Crime No.491/2023 registered with police station Belwandi District Ahilyanagar, for the offences punishable under Sections 307, 120-B, 201 read with Section 34 of Indian Penal Code, under Section 3/25 of the Arms Act. 3.
The learned counsel for the applicant submits that there is no progress in the trial of Sessions Case No. 12/2024. The applicant is behind bars since 16.10.2023. Only two witnesses are examined in the trial. Despite direction of expeditious disposal of the trial, it is yet to be concluded. It is submitted that he is constrained to prefer application for bail. His entitlement of bail on merit is also pressed into service.
4.
Learned A.P.P. submits that there is clinching material on record showing involvement of the applicant in the serious offence. The applicant is inflicted injuries by fire arm weapon. His bail applications were rejected on merits on earlier time and this is successive third bail application, which 1/2
905 BA 273 OF 2026.odt warrants no interference.
5.
I have gone through the F.I.R. and relevant documents in the chargesheet. The involvement of the applicant is evident. He was armed with fire arm weapon and inflected injuries by the pistol. No case is made out for granting bail on merits.
6.
His bail application was rejected by High Court on 22.04.2024 and thereafter on 07.04.2025. I do not find any case is made out to cause any interference in third successive bail application. The trial is underway. It has already been expedited. No further directions are required. 7.
The bail application is rejected.
