Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 273/2022 registered with Mhaswad Police Station, Dist. Nandurbar for the offences punishable U/Sec. 302 of the Indian Penal Code. 2.

Applicant is arrested on 10.11.2022. Charge sheet was filed on 30.01.2023. It is alleged that deceased Lata was assaulted by applicant by smashing her by stone. The means rea is promiscuity of the wife. Informant received the information on 09.11.2022 about the assault on the deceased, who happened to be his cousin.

I have gone through the statements of the witnesses namely Ramesh Pahadsing Choudhari, Ravindra Chhagan

2 925 ba 288.26 Choudhari, Deelip Rajan Ravtale and postmortem report. The statement of Ravindra Choudhari shows that he witnessed assault on 08.11.2022 occurred at 05.30 near the mountains of Toranmal. The deceased having been assaulted by the applicant. Consistently there is version that there were disputes between husband and wife. Applicant was addicted to liquor and use to suspect the character of the deceased. The postmortem report also shows multiple injuries on the person of the deceased. The submission of the learned counsel for the applicant that contents of alcohol were found in the stomach can be dealt with during the course of trial. Prima facie, defence that the deceased might have fallen under the influence of liquor is not probable. 4.

Learned A. P. P. has informed that two witnesses are already examined. The Trial is underway. It is likely to be concluded within a period of six to eight months from today. 5.

In that view of the matter, I am not inclined to entertain the bail application. The bail application is rejected. The Trial in Sessions Case No. 15 of 2023 is expedited. It would be open for the applicant to approach this Court directly in case trial is not concluded within above stipulated period. [ SHAILESH P. BRAHME J. ] bsb/March 26
