The applicant seeks regular bail in connection with Crime No.709/2025 registered with MIDC Police Station, Dist. Jalgaon for offences punishable under Sections 109, 109(1), 189(2), 191(2), 190, 324(4), 125, 351(2), 352, 61(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 3/25 of Arms Act.

The investigation was set in motion on the basis of information given by Chandrashekhar Tryambak Patil. In nutshell it is alleged that his son Karan Patil had some dispute with Kiran Kharche. On 04.10.2025, at about 10:30 p.m., while informant was at his house, accused persons arrived there and started abusing in name of his son. They pelted stones towards house, due to which window shield of house was broken. The

(2) motorcycle parked in front of house was also damaged. The accused persons were saying that informant or his son shall not misbehave with their brother Kiran Kharche. One of them fired two bullets towards house, which hit Television set installed in house and then ran away from spot. The FIR names seven persons who are residents of Supreme Colony, Jalgaon. The aforesaid information was culminated into Crime No.709/2025 against in all 8 accused persons including applicant. 3.

The investigation progressed and charge-sheet has been filed during course of investigation. The applicant has been arrested on 05.10.2025. He was remanded to MCR. Since then, he is behind bar.

After filing of charge-sheet, applicant moved before Sessions Court for grant of regular bail vide application below Exhibit-8 in Sessions Case No.218/2025. The Sessions Judge rejected his application vide order dated 13.01.2026. Hence, this Bail Application.

Mr. D. R. Kale, learned Advocate appearing for applicant submits that except allegation that applicant was one of member of unlawful assembly, there is nothing to attribute against him. The accused Ganesh @ Vicky Gosavi is attributed with firing two bullets, but there is no specific allegation against applicant.

Per contra, Mr. A. R. Kale, learned APP appearing for respondent vehemently opposes application stating that offence is serious. Actually bullet was fired by one of accused, which suggest attempt to commit murder.

Having considered submissions advanced by learned Advocates appearing for respective parties and on perusal of FIR and material in charge-sheet, apparently applicant is named in FIR. The informant nowhere states that he was knowing applicant. Even it is not contention of informant that he had seen faces of accused persons. He implicated names of accused persons on the basis of hearsay information. The statements of witnesses namely Manisha Patil, Gajanan More and Devanand Hole relied by prosecution do not depict as to on what basis applicant is named in FIR or stated to be member of unlawful assembly. No specific role has been attributed against applicant. The applicant is behind bar since last four months. No criminal antecedents of applicant are brought to the notice of this Court. Hence, further detention of applicant would not be necessary. Resultantly, case is made out for grant of bail subject to certain conditions. Hence, the following order:

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Sachin Prabhakar Sonwane be released on

(4) bail in Crime No.709/2025 registered with MIDC Police Station, Dist. Jalgaon for offences punishable under Sections 109, 109(1), 189(2), 191(2), 190, 324(4), 125, 351(2), 352, 61(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 3/25 of Arms Act on furnishing P.B. and S.B. of Rs.50,000/- (Rs.Fifty Thousand only) on following condition:

a.

The applicant shall not tamper with prosecution evidence in any manner.

b.

The applicant shall attend each and every effective date before the Trial Court.

c.

The applicant shall not indulge in criminal activity. (iii) Application is disposed of.
