Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 283/2025 registered with Bhoom Police Station, Tq. Bhoom, Dist. Osmanabad for the offences punishable U/Sec. 309(6), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

It is reported to the police station that informant and his wife were travelling on two wheeler from Latur to Sukta, Tq. Bhoom. When they were in between Hadogri and Hiware, they were intercepted by three persons on the motorcycle. They were robbed, assaulted and threatened by those persons. The ornaments and the cash were robbed.

Learned counsel for the applicant submits that he is falsely implicated in the offence. The prosecution story is unreliable because one of the perpetrators was apprehended, but it was not disclosed. No role is attributed to the applicant. The statements of the witnesses are inconsistent.

Per contra, learned A. P. P. submits that from one of the perpetrators, who was apprehended during the course of investigation few of the articles are recovered. Co-accused is still absconding. The test identification parade is in favour of the prosecution.

As can be seen from first information report and the statements of the witnesses, the prosecution story is that after robbing the couple two persons arrived from village Hiwara, who are stated to have helped the couple by chasing the perpetrators. One of the accused was apprehended and brought to the police station at Bhoom.

The incident in question occurred at 9.00 to 9.30 p.m. on 24.10.2025. F.I.R. was lodged on 00.56 AM of 25.10.2025. At the time of lodging of FIR, one of the accused was already apprehended and brought to the police station. This material fact is not spelt out in the first information report and statement of Jayshree. There is no direct evidence against the applicant. No antecedents are reported against him. Mere recovery from the wive of the applicant is not sufficient to connect the applicant to the crime in question.

He is behind bar since 25.10.2025. The charge sheet has been filed. He deserves to be released on bail.

A.
The bail application is allowed.
B.
Applicant - Navnath @ Bablu S/o Nana Pawar shall be released on bail in respect of Cr. No. 283/2025 registered with Bhoom Police Station, Tq. Bhoom, Dist. Osmanabad for the offences punishable U/Sec. 309(6), 3(5) of the Bhartiya Nyaya Sanhita, 2023 on condition of furnishing P. R. and S. B. bond of Rs. 25,000/- (Rs. Twenty Five thousands only) with one solvent surety of like amount.
C.
The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
D.
Applicant shall cooperate for expeditious disposal of the trial.
