The applicant is seeking bail in respect of offence bearing Crime No.70 of 2025, registered with Azadnagar Police Station, District Dhule, for the offences punishable under Sections 132, 121(1), 351(2) 3(5) of the Bharatiya Nyaya Sanhita and 3, 25 of Arms Act.

Offence committed on 28.03.2025. It is alleged that he is absconding accused and wanted in many offences. He is a habitual offender. The information was received to the police officer about his whereabouts. When he was being apprehended by the police party he desisted. He is alleged to

have abused. He was found with desi make pistol with two live cartridges.

Applicant is arrested on 29.03.2025. Charge-sheet is filed on 17.08.2025. Respondent contested the application on the ground that applicant is a habitual offender. 5.

I have considered the rival submissions of the parties. It is apparent that applicant is involved in various offences and at the relevant time the raiding party wanted to arrest him. But he attempted to flee. He was found with pistol. The overt act alleged against him in the report is not serious enough to detain him behind bars, even after filing of the charge-sheet. 6.

It is pointed out by learned APP that even if he is enlarged on bail, he is likely to be arrested in furtherance of other non-bailable offences registered against him. It would be open for the police personnel to follow due procedure of law and to take action against the applicant. I am of the considered view that his detention in furtherance with the present offence is not required. I, therefore, pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SATTAR MASUM PINJARI shall be released on bail in Crime No.70 of 2025, registered with Azadnagar Police Station, District Dhule, for the offences punishable under Sections 132, 121(1), 351(2) 3(5) of the Bharatiya Nyaya Sanhita and 3, 25 of Arms Act on furnishing P. R. bond of Rs.25,000/- (Rupees twenty five thousands only) with one solvent surety of like amount on the following conditions :

(a) The applicant shall report the Investigating Officer on every Monday from 10.00 a.m. to 4.00 p.m. till conclusion of the trial.

(b) The applicant shall co-operate for speedy disposal of the trial.

(c) It is clarified that the enlargement of the applicant on bail shall not preclude the concern police officers or the competent authority to take action against the applicant in accordance with law.

(iii) Bail application is disposed of accordingly.
