The applicant is seeking bail in respect of offence bearing Crime No.424 of 2025, registered with Shivajinagar Police Station, District Latur, for the offences punishable under Sections 109(1), 189(2), 189(4), 190, 191(3), 324(4), 352, 351(3) of B.N.S.

Incident took place on 26.10.2025. Applicant is arrested on 27.10.2025. Charge-sheet is filed on 21.01.2026. 4.

Learned counsel for the applicant submits that the allegations are not serious in nature. The injuries are not on the vital part. There is no criminal antecedents. Applicant is entitled to release on bail.

Per contra, learned APP submits that it is an offence of forming unlawful assembly. Accused were armed with weapons and assaulted informant and his friend Sanjot. Sanjot received severe injuries and hospitalized. There are eye witnesses to the incident. No case is made out to release him on bail. 6.

I have gone through First Information Report and the statements of the eye witnesses. The incriminating part to the extent of the applicant is that he was present at the time of incident and having wooden log by which he tried to assault the informant on his head but it landed on left hand which was fractured. Sanjot sustained injuries but those are mainly inflicted by co-accused Vazir @ Imran and others. Considering the nature of allegations, I find no reason to detain the applicant behind bar. Hence, I pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant VISHNU SUDHAKAR GAIKWAD shall be released on bail in Crime No.424 of 2025, registered with Shivajinagar Police Station, District Latur, for the offences punishable under Sections 109(1), 189(2), 189(4), 190, 191(3), 324(4), 352,

351(3) of B.N.S. on furnishing P. R. bond of Rs.30,000/- (Rupees thirty thousands only) with one solve surety of like amount on the following conditions :

(a) The applicant shall not contact the prosecution witnesses or tamper the prosecution evidence.

(b) The applicant shall co-operate the Investigating Officer for furnishing any information, if required.

(iii) Bail application is disposed of accordingly.
