The applicant is seeking bail in respect of offence bearing Crime No.383 of 2024, registered with Rahata Police Station, District Ahilyanagar, for the offence punishable under Section 103(1) of Bharatiya Nyaya Sanhita.

It is reported by owner of the agricultural field situated at Chitali Road, Rahata that the informant was informed that the deceased Savita was found dead in full of blood in her shed. There were various injuries on her body and she was reported to be murdered by her brother-in-law/present
applicant. In pursuance of the complaint, applicant is arrested on 03.08.2024. Charge-sheet is filed on 05.11.2024. 4.
Learned counsel for the applicant submits that there is no direct evidence against the applicant except recovery of wooden log. There is no incriminating material against him. He is being implicated due to suspicion.

Per contra, learned APP submits that the statements recorded during the course of investigation would indicate that the applicant was living with the deceased and they used to quarrel frequently. The co-labourer were required to intervene and pacify them. The statement of Kisan would indicate that when he went to call her for work she was found dead. Applicant was not seen thereafter.

I have gone through First Information Report and the statements of various witnesses including that of Kisan. Neither of them have seen the applicant either committing any overt act nor have they seen them together last. The wooden log is recovered at the instance of applicant but that is not sufficient to connect him to the crime.

The statements of the witnesses would indicate that there used to be quarrels between the applicant and deceased.
The suspicion howsoever cannot connect the applicant to the crime unless there is incriminating material against him. I, therefore, pass the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant BABAN GOVIND PAWAR shall be released on bail in Crime No.383 of 2024, registered with Rahata Police Station, District Ahilyanagar, for the offence punishable under Section 103(1) of Bharatiya Nyaya Sanhita on furnishing P. R. bond of Rs.20,000/- (Rupees twenty thousands only) with one solvent surety of like amount on the following conditions :
(a) The applicant shall not tamper with the prosecution evidence and contact the prosecution witnesses.
(b) The applicant shall surrender his Aadhar Card and PAN Card to the Investigating Officer, if any.
(c) The applicant shall co-operate for expeditious disposal of the trial and attend the dates punctually.
(iii) Bail application is disposed of accordingly.
