The applicant is seeking regular bail in connection with Crime No. 54/2025 registered with Dhadgaon Police Station, Dist. Nandurbar for the offences punishable under Sections 3(5), 351(3), 109 of the Bharatiya Nyaya Sanhita, 2023.

It is alleged that due to previous enmity, applicant and co-accused gave dash to the victim on 30.03.2025 at night hours and fled away. Son of the deceased victim and Vansing, who witnessed the incident chased the vehicle. The applicant was seen driving the vehicle. 4.
The applicant is arrested on 26.05.2025. Charge his filed on 16.08.2025. The victim was hospitalized who suffered multiple fractures. 1/3

Learned counsel for the applicant submits that there is no direct evidence against him. F.I.R. is lodged belatedly against him due to previous enmity.

Per contra, learned A.P.P. would point out the spot panchnama and the statement of the witnesses. It is submitted that due to previous enmity a mens rea can be inferred for committing the offence. 7.
I have considered first information report, spot panchmama and statements of the witnesses especially Mahesh and Vansing. There is no material to infer that due to previous enmity the victim is tried to be run over by the accused persons. The victim received injuries on his legs, multiple fractures. The circumstances are not strong enough to deny bail to the applicant. The investigation is over. There is no purpose to detain the applicant behind bars.

Bail Application is allowed.

The applicant shall be released on bail in connection with Crime No. 54/2025 registered with Dhadgaon Police Station, Dist. Nandurbar for the offences punishable under Sections 3(5), 351(3), 109 of the Bharatiya Nyaya Sanhita, 2023, on following conditions: (a) The applicant shall furnish P.R. bond of Rs. 20,000/- (Rs. Twenty Thousand only) with one solvent surety of like amount.
(b) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses in any manner.
(c) The applicant shall furnish his mobile/cell number and address to the investigating officer.

(d) The applicant shall stay away from entire Dhadgaon Taluka, till conclusion of the trial, save and except for attending the trial.
