2026:BHC-AUG:15003
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD BAIL APPLICATION NO. 397 OF 2026
1. GANGARAM NAMDEV JARIPATKE
2. KISHABAI GANGARAM JARIPATKE
VERSUS
THE STATE OF MAHARASHTRA ...
Advocate for Applicants : Mr. Pankaj A. Bharat h/f Mr. Uddhav Laxmanrao Momale.
APP for Respondent/s-State : Ms. P. V. Diggikar. ...
CORAM : SHAILESH P. BRAHME, J.
DATE : 07.04.2026 PER COURT :- 1.
Heard both sides.
2.
The applicants are seeking enlargement on bail in respect of offence bearing Crime No.646 of 2025, registered with Udgir Rural Police Station, District Latur, for the offences punishable under Sections 103(1), 103(2), 85, 3(5) of the Bhartiya Nyaya Sanhita.
3.
Applicants are parents-in-law of deceased Anjali who are facing allegations of harassment and cruelty. It is reported by father of deceased Anjali that the marriage of his daughter was solemnized on 20.06.2020 with Navnath. Husband, applicants and relatives used to insist her to bring money. There was
harassment and torture to deceased Anjali which she was reporting to her parents. In August 2023, she was assaulted, abused and threatened. Again the incident was repeated on 18.06.2024. The torture continued despite giving birth to a son. On 23.10.2025, she was found unconscious with injuries on the body. It was reported that she committed suicide. 4.
Applicants are arrested on 25.10.2025. Charge-sheet is filed on 16.01.2026.
5.
In this backdrop learned counsel for the applicants submits that there is no specific overt act on the part of the applicants. In fact they carried her to the hospital for treatment. They are aged and behind bars for sufficient period. 6.
Per contra, learned APP would contest the application submitting that it was a case of death by strangulation. Applicants and husband Navnath are liable for the death. The incriminating material is collected showing recurring instances of the harassment for demand of money on various occasions. The injuries on the body would suggest that it was not a case of suicide but she has been strangulated. The statement of witness Trambak Pundlik Kadam also corroborates prosecution theory.
7.
Applicants, their son and other members of the family are added as accused. Applicants are aged and behind bar since 25.10.2025. The investigation is over and the chargesheet is filed in the matter. First Information Report shows omnibus allegations against the applicants. No specific role is attributed against them. Though the harassment was recurring, their son appears to be the main perpetrator who is behind bars. No mesne rea can be inferred from the papers of investigation.
8.
The statement of Anant who is the independent witness shows that applicants who are instrumental in shifting the deceased to the hospital for the treatment. It is further corroborated by statement of Vaishali. There is a room to say that applicants tried to give medical treatment. There is sufficient incarceration. They are not required to be detained any further. I, therefore, pass the following order :
