Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 80/2022 registered with Ambhora Police Station, Tq. Ashti, Dist. Beed for the offences punishable U/Sec. 109, 307, 353, 332, 333, 143, 148, 149, 427 of the Indian Penal Code (R.C.C. No. 201/2022 registered with J. M. F. C. Ashti). 3.

It is reported to the police by Police Naik Mr. Pralhad Vishwanath Deode that on 19.05.2022 police party had been to village Parodi in search of a prime suspect Salim Narayan Bhosle. Police party was attacked, abused and assaulted by the applicant and co-accused, while discharging official duty.

2 15 ba 404.26 Applicant is alleged to have given blow by stick on the head of the informant, other co-accused also assaulted police personnel and damaged the Government vehicle. In pursuance of the offence registered on 19.05.2022, the applicant came to be arrested on 23.01.2026. The charge sheet was already filed. After arrest of the applicant supplementary charge sheet is filed on 02.04.2026.

In the above backdrop, learned counsel for the applicant submits that he is falsely implicated in the offence. The injuries are simple in nature. There was no intention to cause any grievous hurt to the police personnel. Further incarceration is not required.

Learned A. P. P. submits that applicant and other coaccused have committed offence by forming unlawful assembly. Police personnel were attacked by sticks. The injuries of one of the victims - Shivdas Ramesh Kedare are grievous in nature and a fracture. Applicant and co-accused were shielding the suspect Salim Narayan Bhosale. There is ample material to show inculpability. 6.

Applicant was arrested after four years from the date of registration of the offence. It is informed by the learned A. P. P. that no steps were taken to secure his presence during the interregnum period. Applicant and co-accused are alleged to have committed assault on police party, when they were

First information report spells out the incriminating role of applicant in assaulting informant by stick on his head. I have gone through the injury certificate of the informant. Two simple injuries are seen. One is on the scalp in the form of contusion and another is on the face. Considering the nature of the injuries, I find that further detention is not required. 8.

I have gone through the statements of eye witness Sanjay Maruti Kale and other injured witnesses. The only incriminating material is that applicant participated in the overt act of causing injuries to the informant. Considering overall circumstances, I am inclined to grant him bail. I, therefore, pass following order.

O R D E R

A.

The bail application is allowed.

B.

Applicant - Baban @ Sandip Dnyaneshwar Bhosale shall be released on bail in respect of Cr. No. 80/2022 registered with Ambhora Police Station, Tq. Ashti, Dist. Beed for the offences punishable U/Sec. 109, 307, 353, 332, 333, 143, 148, 149, 427 of the Indian Penal Code (R.C.C. No. 201/2022 registered with J. M. F. C. Ashti) on condition of furnishing P. R. bond and S. B. of Rs. 30,000/- (Rs. Thirty thousands only) with one solvent surety of like amount.

The applicant shall desist himself from indulging in similar sort of illegal activities in future.

D.

The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.

E.

The applicant shall cooperate in expeditious disposal of trial.

F.

The applicant shall surrender his Aadhar and Pan cards to the investigating officer.

G.

The applicant shall give his mobile/cell number and address to the investigating officer.

H.

Bail application is disposed of.
