The applicant is seeking bail in respect of offence bearing Crime No.971 of 2025, registered with Shrirampur City Police Station, District Ahilyanagar for the offences punishable under Sections 64(2), 77, 79, 308(4), 117(2), 118(1), 115(2), 352, 351(2), 328, 3(5) of Bhartiya Nyaya Sanhita.

He is arrested on 11.11.2025. Charge-sheet is filed on 02.01.2026.

Informant approached Police Station with a grievance that she is married and has a son. When she had been to Shrirampur in September 2020, obscene photographs of herself
and her sister were secretly taken by applicant while bathing. She was subjected to forcible sexual relations by giving threat to viral said photos. She is stated to have been blackmailed and amount of Rs.70,000/- and Rs.40,000/- were extracted by the applicant. She is subjected to sexual intercourse on couple of times in September 2020 and August 2025. It is further alleged that she was abused, threatened and assaulted by the applicant. Applicant is alleged to have attempted to throw acid on her.

Learned counsel for the applicant submits that the prosecution theory is imaginary. Informant is married and having a child. The relation was consensual since last 5 years. The episodes mentioned in the report are unfounded and concocted. Applicant is falsely implicated in the offence. He was assaulted on 07.11.2025 by the informant and her relatives. Offence bearing Crime No.972 of 2025 was lodged. There is absolutely no material to show payment of extorted amount.

Per contra, learned APP submits that clinching material has been collected during the investigation including statements of sister, Ratna, Anita, Manoj and Shyam. Applicant
has assaulted the informant and from time to time threatened her.

Admittedly informant is major. She is married and having a son. The alleged overt act commenced from September 2020 till 2025. Informant is alleged to have threatened by disclosing obscene photos and big amounts were extracted from her. No material is collected to show that there was any extortion. The incriminating data from the mobile handset either of applicant, victim or her sister has not been collected.

It can be gathered from the papers of the investigation that informant was responding the applicant. Repetitively sexual relations for prolonging five years would indicate the consent prima facie.

Applicant also lodged First Information Report. The allegations in First Information Report are unfounded. The false implication cannot be ruled out. Interestingly, the statement of sister Mariya does not corroborate fact that her obscene photographs were also taken by the applicant which is stated in the First Information Report.

Applicant is behind bar since 11.11.2025. No incriminating antecedents is reported against him. It is desirable to grant bail. I, therefore, pass the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant SUNNY RAJU SHIRSATH shall be released on bail in Crime No.971 of 2025, registered with Shrirampur City Police Station, District Ahilyanagar for the offences punishable under Sections 64(2), 77, 79, 308(4), 117(2), 118(1), 115(2), 352, 351(2), 328, 3(5) of Bhartiya Nyaya Sanhita, on furnishing P. R. bond of Rs.30,000/- (Rupees thirty thousands only) with one solvent surety of like amount on the following conditions :
(a) The applicant, his relatives or anybody through him shall not contact the prosecution witnesses including informant, her parents and relatives from Shrirampur and tamper with the prosecution evidence.
(b) The applicant shall co-operate for expeditious disposal of the trial and attend the dates punctually.
(c) The applicant shall surrender his Aadhar Card and PAN Card to the Investigating Officer, if any.
(iii) Bail application is disposed of accordingly.
