Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 94/2025 registered with Shivaji Nagar Police Station, Nanded, Tq. & Dist. Nanded for the offences punishable U/Sec. 109, 310(2), 311, 352, 351(2), 351(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sec. 4/25 of the Arms Act.

It is alleged that informant was called by the applicant when he was passing by her house, near railway track. No sooner he entered the house, applicant demanded amount and started scuffle and grabbed Rs. 3,000/-. Her husband and son
2 83 ba 414.26 who are the co-accused joined her. Informant was assaulted and abused. The co-accused inflicted injuries by knife on abdomen, hand and the shoulder.

Learned counsel for the applicant submits that the only allegation against the applicant is demand of money and scuffle. She is not the author of the injuries by knife. It is submitted that only two injuries are shown to be grievous injuries. There is no reason to detain the applicant behind bars as investigation is over.

Learned Assistant Public Prosecutor submits that applicant is habitual and as many as eight offences are registered against her. She has peculiar modus operendi in indulging road robberies. The injury certificate shows that in all four injuries are inflicted by knife and out of them two are grievous in nature.

The first information report shows that informant was called inside by the applicant and money was demanded. She is stated to have snatched Rs. 3,000/- by scuffle. Her husband and son are stated to have further abused and assaulted him. The injuries inflicted on the person of the informant were by sons. Considering the nature of the allegations I find that the role played by the applicant is venial.

There are eight offences registered against her and she is
3 83 ba 414.26 repeatedly indulging in the road robberies. But that itself cannot be a ground to deny bail. She is arrested on 11.03.2025. Charge sheet is filed on 04.09.2025. She is entitled to be released on bail.

I therefore, pass following order.
O R D E R
A.
The bail application is allowed.
B.
Applicant - Gangasagar @ Maya Raghvindar @ Raju Mathekar shall be released on bail in respect of Cr. No. 94/2025 registered with Shivaji Nagar Police Station, Nanded, Tq. & Dist. Nanded for the offences punishable U/Sec. 109, 310(2), 311, 352, 351(2), 351(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sec. 4/25 of the Arms Act on condition of furnishing P. R. bond of Rs. 20,000/- (Rs. Twenty thousands only) with one solvent surety of like amount.
C.
The applicant shall desist herself from indulging in road robberies or in similar type of offences.
D.
If the applicant is found to have indulged in similar type of offence or road robbery that would entail cancellation of bail. E.
The applicant shall report the police station concern on every Saturday from 10.00 AM to 3.00 PM till conclusion of trial.

The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
G.
Applicant shall cooperate in expeditious disposal of the criminal case.
H.
Bail application is disposed of.
