The applicant is seeking enlargement on bail in respect of offence bearing Crime No.462 of 2025, registered with Bhokar Police Station, District Nanded, for the offences punishable under Sections 351(3), 137(2), 87, 74, 75, 64, 143(2), 143(3), 296, 61(2), 351(4), 3(5), 49, 126(2), 127(2), 351(2), 352, 238, 3(5) of Bhartiya Nyaya Sanhita and Section 67 of Information Technology Act.

Applicant is arrested on 20.09.2025. Charge-sheet is filed on 17.11.2025. A copy of order dated 06.04.2026 passed in Bail Application 316 of 2026 is placed on record. On the ground of parity, applicant is seeking bail.

The submissions are contested by the learned APP. Learned APP submits that the role played by the applicant is distinct. His involvement is apparent. He is in collusion with co-accused to facilitate main perpetrator to commit the offence. Considering the seriousness of the evidence, application is liable to be rejected.

It is alleged that victim was abducted from Nanded and taken to various places by main perpetrator Shubham who is enlarged on bail vide order dated 06.04.2026. Applicant is alleged to be associated with Shubham and helped him to abduct her. He is alleged to have threatened her. 7.

The allegations against the present applicant are venial. The main perpetrator is released on bail by assigning reasons. I adopt the same reasons and the course in granting bail. One antecedent is reported against the applicant. That would not sufficient to deny bail. I, therefore, pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant AKSHAY DNYANESHWAR YASHWANTKAR shall be released on bail in Crime No.462 of 2025, registered with Bhokar Police

Station, District Nanded, for the offences punishable under Sections 351(3), 137(2), 87, 74, 75, 64, 143(2), 143(3), 296, 61(2), 351(4), 3(5), 49, 126(2), 127(2), 351(2), 352, 238, 3(5) of Bhartiya Nyaya Sanhita and Section 67 of Information Technology Act on furnishing P. R. bond of Rs.30,000/- (Rupees thirty thousands only) with one solvent surety of like amount on the following conditions :

(a) The applicant shall stay away from entire Hadgaon Taluka till conclusion of the trial and furnish his address and contact number to the Investigating Officer.

(b) The applicant shall surrender his Aadhar Card and PAN Card.

(c) The applicant shall co-operate for the expeditious disposal of the trial.

(d) The applicant shall not contact prosecution witnesses or tamper the prosecution evidence.

(iii) Bail application is disposed of accordingly.
