The applicant is seeking regular bail in connection with Crime No. 31/2023, registered with Karmad Police Station, District Chhatrapati Sambhajinagar Rural, for the offences punishable under Sections 307, 323, 504, 506, 34 of the Indian Penal Code.

It is reported to the police by the informant Kalandar Laddu Shaha that due to civil dispute a free fight took place on 11.02.2023, in which applicant is alleged to have abused and assaulted the informant by stone. He is further alleged to have assaulted by kicks. 4.
The applicant was initially granted bail on certain conditions. He again committed offence bearing Crime No. 211/2024 assaulting son of the informant. The bail granted by coordinate bench of this Court vide order 1/3
dated 06.04.2023 was cancelled by the High Court on 28.02.2025. Thereafter application Exh. 17 was presented before the Sessions Court for bail. It was rejected on merits. The order is confirmed up to the Supreme Court. In pursuance of the liberty granted by the Apex Court, separate bail application was moved, which was rejected on 13.02.2026. Thereafter, applicant has approached this Court.

Learned counsel for the applicant submits that informant has filed separate application for assist to public prosecutor in the present case. The informant is stated on oath in paragraph no. 4 of the application that the dispute has been settled amicably with the applicant and other persons, and he does not have any objection in granting bail. As the dispute is settled, there is no possibility of indulging in any such activity in future. The applicant is enlarged on bail in subsequent Crime No. 211/2024. 6.
Learned A.P.P. submits that the applicant is persistently indulging in the illegal activities. The Supreme Court did not grant any relief to him. The consent of the informant is immaterial. The police machinery has been engaged and being used, which needs to be compensated. 7.
I have gone through the allegations attributable to the applicant. The informant, who sustained injuries has stated on oath that he does not have objection for releasing the applicant on bail. The civil dispute between them appears to have been settled. The applicant is granted bail in Crime No. 211/2024 also. Considering the nature of the allegations, I am inclined to grant bail.

The submissions of the learned A.P.P. cannot be overlooked. There are multiple rounds of litigation in securing bail. The police machinery is being consistently kept engaged by the parties. The applicant is ready to pay costs of Rs. 5000/- 9.
The Bail Application is allowed.

The applicant Hakkani Khan s/o Ajmer Khan shall be released on bail in connection with Crime No. 31/2023, registered with Karmad Police Station, District Chhatrapati Sambhajinagar Rural, for the offences punishable under Sections 307, 323, 504, 506, 34 of the Indian Penal Code, on following conditions:
(a) The applicant shall furnish P.R. bond of Rs. 15,000/- (Rs. Fifteen Thousand only) with one solvent surety of like amount.
(b) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses. (c) The applicant shall furnish his mobile/cell number and address to the investigating officer.
(d) The applicant shall cooperate in expeditious disposal of the trial.
(e) The applicant shall pay costs of Rs. 5000/- (Rs. Five Thousand only) to Government Pleader Office, High Court, Bench at Aurangabad, within a period of two weeks. (f) The applicant shall desist from indulging in such type of activities in future and any further indulgence would entail cancellation of this order of bail.
